End-User License Agreement

Scope of License

This End-User License Agreement ("EULA") is a binding agreement between you and Stimly. By installing or using the Stimly application (the "Licensed Application"), you accept it.

The developer grants you a non-transferable, non-exclusive license to use the Licensed Application on any Apple-branded products that you own or control, and as permitted by the Usage Rules set out in the App Store Terms of Service.

Consent to Use of Data

You agree that the developer may collect and use technical data and related information — including but not limited to technical information about your device, system, and application software — to facilitate the provision of software updates, product support, and other services.

We process this data in accordance with our Privacy Policy, which explains what we collect and the choices you have.

Termination

This license is effective until terminated by you or the developer. Your rights under this EULA will terminate automatically, without notice, if you fail to comply with any of its terms.

Upon termination, you must cease all use of the Licensed Application and delete all copies in your possession or control.

Services & Third-Party Materials

The Licensed Application may enable access to services and websites operated by the developer or by third parties. The developer is not responsible for any third-party materials or websites, and you use them at your own risk.

No Warranty

You acknowledge that the Licensed Application is provided "as is" and "as available", with all faults and without warranty of any kind. To the maximum extent permitted by applicable law, the developer disclaims all warranties, whether express, implied, or statutory.

Limitation of Liability

To the extent not prohibited by law, in no event shall the developer be liable for personal injury, or for any incidental, special, indirect, or consequential damages whatsoever arising out of or related to your use of, or inability to use, the Licensed Application.

No Medical Device

The Licensed Application is a wellness tool. It is not intended to diagnose, treat, cure, or prevent any disease or health condition, and it is not a medical device. Always consult a qualified clinician for medical advice.

Export Compliance

You may not use, export, or re-export the Licensed Application except as authorised by United States law and the laws of the jurisdiction in which it was obtained, including Polish and European Union law.

Apple as Third-Party Beneficiary

You acknowledge that Apple and Apple's subsidiaries are third-party beneficiaries of this EULA, and that, upon your acceptance, Apple has the right (and is deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.
