Definitions & Scope
These Terms of Service ("Terms") govern your access to and use of Stimly — the caffeine tracking application available on iOS, Android, and Web (the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.
"Stimly", "we", "us", and "our" refer to the operator of the Stimly application. "You" and "your" refer to the individual using the Service.
If you do not agree to these Terms, do not use the Service. These Terms should be read alongside our Privacy Policy, which explains how we collect and use your data.
Account Registration
To use Stimly, you must create an account using a valid email address. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
You must be at least 13 years old (or 16 in the EEA) to create an account. By creating an account, you represent that you meet this age requirement.
You agree to provide accurate information and to keep your account details up to date. We reserve the right to suspend or terminate accounts that violate these Terms.
Acceptable Use
You agree to use Stimly only for its intended purpose: personal caffeine intake tracking and wellness information. You may not:

Intellectual Property
All content, features, and functionality of the Service — including but not limited to the pharmacokinetic engine, user interface, design, branding, and documentation — are owned by Stimly and are protected by applicable intellectual property laws.
Your caffeine intake data, biometric profile, and personal settings remain your property. You grant us a limited licence to process this data solely to provide the Service, as described in our Privacy Policy.
You may not use the Stimly name, logo, or branding without our prior written consent.
Subscriptions & Payments
Stimly offers a free tier and a paid subscription ("Stimly PRO"). PRO subscriptions provide access to advanced metabolism features, extended analytics, and other premium capabilities.
Subscriptions are billed on a recurring basis (monthly or yearly) through the platform on which you subscribe — Apple App Store (iOS), Google Play Store (Android), or Stripe (Web). All payments are processed by the respective platform; Stimly never receives or stores your payment card details.
You may cancel your subscription at any time through your platform's subscription management. Cancellation takes effect at the end of the current billing period. We do not offer prorated refunds for partial billing periods.
Refund requests for App Store and Google Play purchases are handled by Apple and Google respectively, in accordance with their refund policies. For web purchases processed by Stripe, contact support@stimly.me.
Disclaimers
Stimly is a personal wellness tool, not a medical device. It does not provide medical advice, diagnosis, or treatment recommendations. The pharmacokinetic models used in Stimly are based on published scientific research and are intended for informational purposes only.
Caffeine affects individuals differently. The predictions generated by Stimly are estimates based on population-level research and your self-reported biometric profile. They are not a substitute for professional medical advice.
If you are pregnant, have a cardiovascular condition, are taking medication that may interact with caffeine, or have any other health concern, please consult a qualified healthcare professional before making decisions based on Stimly's output.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability
To the maximum extent permitted by applicable law, Stimly and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or personal injury, arising from your use of or inability to use the Service.
Our total liability for any claims relating to the Service is limited to the amount you paid for Stimly PRO in the twelve (12) months preceding the claim, or fifty euros (€50), whichever is greater.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.
Termination
You may stop using Stimly and delete your account at any time from Settings → Privacy & Data → Delete my account. Account deletion is permanent and removes all your data from our systems.
We may suspend or terminate your access to the Service if you violate these Terms or engage in conduct that we reasonably believe is harmful to other users, to Stimly, or to third parties.
Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination (including Disclaimers, Limitation of Liability, and Governing Law) will continue to apply.
Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of Poland, without regard to conflict of law principles. If you are a consumer in the European Union, you also benefit from any mandatory consumer protection provisions of your country of residence.
Any disputes arising from these Terms or the Service shall first be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the competent courts of Warsaw, Poland, provided that consumers in the EU may bring proceedings in their country of residence.
Nothing in these Terms affects your statutory rights as a consumer under applicable EU or national law.
Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you via an in-app prompt and update the "Last updated" date at the top of this document.
By continuing to use the Service after changes take effect, you agree to the updated Terms. If you do not agree to the updated Terms, you should stop using the Service and delete your account.
We encourage you to review these Terms periodically to stay informed about the conditions governing your use of Stimly.
